Drip irrigation system for ornamental plants in a greenhouse The projects included in the Actions Programme will be considered urgent for recruitment and administrative purposes, and in particular with respect to proceeding to evaluate the environmental impact, with a considerably reduction in the procedures adopted doing this.

All the referred actions considered under the Royal Decree are declared of general interest or integrated into the Hydrological Plans of the respective river basins, and therefore they will implicitly be considered of public use, and in the cases foreseen by the Revised Text of the Water Act, approved by Royal Legislative Decree 1/2001, of July 20 2001, affected by the need for the occupation of lands and acquisition of rights for the purposes of expropriation and temporary occupation.

Remote-controlled irrigation group hydrant concentrating  station The contractual dossiers necessary for implementing the actions considered under this Royal Decree, will be considered urgent for the purposes of article 71 of the Revised Text of the Public Administrations Contracts Act approved by Royal Legislative Decree 2/2000, dated June 16, 2000.

If due to any circumstance that should make it unfeasible to construct any infrastructure, it were not possible to modify the Actions Programme, the respective management centre will make the necessary proposal to the Ministry in question who will settle the issue regarding the substitution of one infrastructure for another one with similar characteristics that has already been declared of general interest or included in the respective basin plan, provided that it ensures the compliance of the same objectives.

Forwards side cart on a plot of corn plants Processing of the projects is subject to Royal Legislative Decree 1302/1986, of June 28 1986, on the Evaluation of Environmental Impact, modified by Act 6/2001, of May 8 2001.

The projects promoted and authorised by the Ministry of Agriculture, Fisheries and Food included in Attachment 11 of Royal Legislative Decree 1302/1986 must be submitted to the Directorate-General for Quality and Environmental Evaluation of the Ministry of the Environment, the environmental body, including an environmental document on the project that must contain the following information, at least:

  1. Project definition, characteristics and location.
  2. The most important alternatives studied.
  3. Analysis of the potential environmental repercussions.
  4. Preventive, corrective or compensatory measures adopted to provide for the adequate protection of the environment.
  5. The method used to monitor that compliance with the protective and corrective indications and measures contained in the environmental document is fully guaranteed.

The environmental body will decide whether the projects should be submitted or not to the Environmental Impact Evaluation, by duly consulting at minimum the pertinent environmental body of the Autonomous Communities affected.

Taking into consideration the special circumstances of the present Royal Decree, an urgent procedure will be applied by which the time necessary for carrying out the ordinary procedure will be reduced by half. However, in the event of having to submit the project to public opinion, the term for making allegations will not be less than twenty days.
